Texas Hemp Litigation Alert

In the SS Distro USA LLC et al. v. Texas Department of State Health Services case, the court denied the plaintiffs’ request for a temporary restraining order. As a result, the current DSHS enforcement standards remain in place.

A temporary-injunction hearing is now scheduled for October 30, 2026, at 9:00 a.m. That hearing will address whether DSHS may continue applying the challenged enforcement standards while the lawsuit moves forward.

To be clear: the TRO denial does not provide Texas hemp retailers with new protection from DSHS enforcement, nor should it be interpreted as authorization to return THCA flower to shelves.

It’s the temporary-injunction hearing, before Judge Maria Cantú Hexsel of the 53rd District Court, at the Travis County Civil and Family Courts Facility in Austin.

The earlier TRO hearing was the one that got bumped from Thursday, August 27 to Friday, August 28 at 3 p.m.

So for your calendar, October 30 at 9:00 a.m. is the next major SS Distro hearing date.
